RESTRICTIVE COVENANTS ON FILE APPLICABLE TO HUNTERS HOLLOW SUBDIVISION
(Note: These Covenants apply to both Owners and Renters, Members of HHHA and Non-Members. The Hunters Hollow subdivision has slightly different covenants applicable to the different development plots within the subdivision. The below covenants note common restrictions applicable to all residences in the subdivision).
1. Not more than one single family residence (with garage or carport) and one 6 foot by 6 foot detached storage building is permitted on any lot in the subdivision (waivers for storage building sizes may be granted by the homeowner's association upon written request).
2. No structure may be erected closer than 30 feet to any street.
3. No noxious of offensive trade or activity may be carried on on any lot, nor may anything be done on a lot which may be or may become an annoyance or nuisance to the neighborhood.
4.The minimum heated area of the main building structure on any lot, exclusive of open porches, carports, and garages, shall be not less than 1700 square feet (may vary) in the case of a one story residence and not less than 1800 square feet (may vary) in the case of a one and one-half story or two story residence. No building may be erected on any lot until the design and plot plan of the building has been approved in writing by Boyle Investment Company or a committee appointed by Boyle Investment Company. Boyle Investment Company or its committee may restrict the quality of workmanship, materials, harmony of external design with the existing structure(s), and location with respect to topography and finished grade elevation.
5. No recreational vehicle, boat, or any type of trailer may be parked or stored on any lot unless under a carport or in a garage. All passenger automobiles in use must be parked either on the driveway or in the carport or garage. Vehicles must not be parked in the front yard. No tractor or trailer may be parked on any lot or in the street in front of any house.
6. No motor vehicle or any other vehicle, including a boat, motor, boat trailer, lawn mower, or similar vehicle, may be stored on any lot for the purpose of repair, no A-frame or motor mount may be placed on any lot, and no disabled or inoperative vehicle may be stored on any lot.
7. No structure of a temporary character, such as a trailer, garage, barn, or other outbuilding, may be used on any lot at any time as the residence, either temporarily or permanently. No structure of any kind, including but not limited to television, radio, or other antenna may be erected which extends more than 5 feet above the highest point of the house roof.
8. No fence may be erected on any lot other than a chain link or wooden fence. No fence may exceed 6 feet in height, and no fence shall be either constructed or maintained between the front of any dwelling and the street. No fence may be erected between the side of a residence and the street on any corner lot except that it shall be permissible to erect a fence from the house to the side lot line immediately in front of the rear entrance door.
9. Vegetable gardening will be allowed only to the rear of the house. No animals, livestock, or poultry of any kind may be raised , breed, or kept on any lot, except that dogs, cats, and other household pets may be kept if they are not bred or kept for any commercial purpose. No commercial breeding of pets allowed.
10. Any special landscaping screens, including earthen burns or embankments, fencing, entry ways, or plant material, must remain in place and may not be removed.
11. These covenants are binding on all homeowners in the subdivision for a period of 30 years from the date of recording, after which time these covenants will be automatically extended for successive periods of 10 years each unless an instrument signed by a majority of the then-owners of the lots in the subdivision has been recorded agreeing to change the covenants in whole or part. Boyle Investment Company may impose additional or separate restrictions at the time of sale of any lot sold in the sub-division, and may amend these restrictions without the approval of the owners of the lots within the subdivision.
12. Any owner or group of owners of any lot or lots in the subdivision may initiate legal action to enforce any of the covenants or restrictions recited above, to prevent further violation of the covenants or restrictions, or to recover damages for such violations.
The Hunters Hollow Homeowners Association would appreciate your not parking your vehicle on the street overnight. Overnight street parking creates a dangerous situation. See covenant No. 5.
